Terms of Use of MyGIX – The German-Israeli Exchange Network
1. Scope of application
1.1 These terms and conditions apply to the use of the internet platform "MyGIX – The German-Israeli Exchange Network" both in the desktop version and via the mobile app. MyGIX – The German-Israeli Exchange Network is operated by ConAct - Koordinierungszentrum Deutsch-Israelischer Jugendaustausch, Altes Rathaus – Markt 26, 06886 Lutherstadt Wittenberg (hereinafter "ConAct").
1.2 The use of the internet platform is exclusively subject to these terms of use in the version valid at the time of the conclusion of the contract (registration). Deviating terms and conditions of the users shall not apply unless ConAct has expressly agreed to their validity.
2. Description of services
2.1 With the Internet platform, ConAct provides registered users with a communication platform with various functions that are intended to enable networking, the exchange of experiences, discussions and joint, interactive work by users as well as the presentation of ideas within the framework of contacts from German-Israeli exchange programs and volunteer services.
2.2 The platform is available to users in both a desktop version and a mobile app.
2.3 The target group is former, current and future participants of German-Israeli youth exchanges in the field of school, extracurricular and vocational youth exchanges as well as volunteer services in Germany and Israel; as well as organizers of German-Israeli youth exchanges and experts and teachers in German-Israeli youth exchanges. Users who do not wish to use the platform in the context of German-Israeli exchange contacts are hereby informed that in this case they must use a different system. If users repeatedly violate this requirement, their user account may be deleted.
2.4 The internet platform is intended for users who are at least 12 years old.
2.5 ConAct endeavors to make access to the internet platform available to all users 24 hours a day, seven days a week. However, temporary interruptions of service, in particular due to the usual maintenance work, system-immanent disturbances of the internet as well as in case of force majeure, are possible. Users are therefore not entitled to uninterrupted access to the Internet platform at all times. No specific availability is owed.
3. Costs
3.1 ConAct does not charge users for the use of the internet platform. The mobile app for using the platform is also free of charge.
3.2 When using the internet platform, the user may incur internet connection costs, which depend on the respective contract of the user or any other contracts and therefore cannot be the subject of these terms and conditions.
4. Registration (conclusion of contract)
4.1 Upon registration, the contract between the user and ConAct is concluded.
4.2 To register, the user must click on the menu item "Sign up" on the Internet platform and truthfully fill in at least the mandatory fields of the registration form, i.e. specify an e-mail address and a password. Furthermore, the user must agree to the legal texts, i.e. the terms of use formulated here and the data protection provisions.
4.3 The user can correct, change and delete entries in the form at any time up to the point of submission. If the information does not meet the requirements, the user will receive a corresponding message. By clicking on the "Sign up" field, the user submits a binding application for the conclusion of a contract for the use of the Internet platform. The registration is thereby completed and the form is sent to ConAct. In response to this application, the user receives an automatically generated confirmation e-mail to the e-mail address entered by him/her. With the hyperlink contained in the confirmation e-mail, it is possible to fully activate the user's account. With the acceptance of the first login and the provision of the service, ConAct accepts the application.
4.4 Users who are not of legal age may only register with the consent of their legal guardians.
4.5 In the event of incomplete or incorrect data in the mandatory fields, in particular in the event of an incorrect e-mail address, ConAct reserves the right to delete the corresponding user account. In this case, however, the user can create a new user account by entering his or her data completely and correctly.
4.6 The following languages are currently available to the user for the conclusion of the contract: German and English. Communication with ConAct can take place in German and English.
4.7 The user must accept these terms of use when registering and can view them here. They can be saved using the "Save" function of the web browser and printed out using the "Print" function of the web browser. Apart from the terms of use, no contract text is saved. In their current version, these terms and conditions are made available on MyGIX – The German-Israeli Exchange Network.
5. Rules of conduct of the users, exemption
5.1 The users commit themselves to a respectful, appropriate and topic-related interaction within the internet platform.
5.2 Users shall comply with the applicable legal provisions when using the internet platform. In particular, photographs of third parties or photographs showing third parties may only be posted if this is legally permissible, for example because these third parties have given their consent. In the case of minors, the consent of their legal guardians must be obtained.
5.3 In particular, users are prohibited from,
- posting content without having the necessary rights to do so,
- posting content protected by law (e.g. by copyright, trademark, patent, design or utility model law) or advertising, offering or selling goods or services under signs protected by law (e.g. trademarks) without being entitled to do so,
- posting content that is discriminatory, inhumane, promotes or condones terrorism, is insulting, unlawful or contrary to public decency,
- posting pornographic content or content that violates the laws for the protection of minors or to advertise, offer or distribute pornographic content or content that violates the laws for the protection of minors,
- harassing other users unreasonably (especially through spam),
- engaging in or promoting commercial and anti-competitive activities,
- engaging in actions that are likely to impair the functionality of the infrastructure provided by ConAct, in particular to place an excessive load on it.
5.4 In case of violation of the above rules or illegal actions of users within the internet platform, ConAct is entitled at its own discretion to exclude users temporarily or permanently from the use of the internet platform (including the deletion of the user's account) and, if necessary, to take further measures to stop the violation. In such cases, ConAct is in particular entitled to remove content without prior notice.
5.5 Furthermore, the user shall indemnify, hold harmless and defend ConAct and its respective representatives from and against any claims (including reasonable attorneys' fees) asserted by third parties due to the alleged violation of these provisions or their rights. In the event of a claim by a third party, the user is obligated to immediately provide ConAct with all information necessary for an examination of the third party's claims.
6. Communication of offensive content
Users may at any time notify ConAct and its representatives of content they find objectionable. The notification can be made in particular by e-mail or via the link provided for this purpose within the internet platform.
7. Rules of conduct and responsibility of ConAct
7.1 ConAct will view the communication of users within groups on an ad hoc basis, especially if offensive content from groups has been reported.
7.2 The use of the internet platform is of no significance for the processing and approval of the funding applications received by ConAct and has no influence on this.
7.3 ConAct cannot technically determine with certainty whether registered users actually represent the person they claim to be. ConAct therefore offers no guarantee for the actual identity of the users. Each user must therefore convince him/herself of the identity of the other users.
7.4 ConAct assumes no responsibility for the content, data and/or information provided by users. In particular, ConAct does not guarantee that this content is true, fulfills a specific purpose or can serve such a purpose.
8. Contract period
8.1 The user can terminate the membership in the internet platform at any time without giving reasons by clicking on " Yes, I want to leave this network " in the user account. Alternatively, the user can contact ConAct in writing or by e-mail info@mygix.org.
8.2 ConAct may terminate the membership of users at any time with 14 days' notice in writing or by e-mail to the user.
8.3 The right of both parties to terminate the contract for good cause shall remain unaffected. ConAct shall be deemed to have good cause if the user violates these terms of use not only insignificantly or repeatedly, in particular if the user violates the aforementioned rules of conduct for users.
8.4 Upon termination, the user account and the user's account content will be deleted completely and irretrievably. ConAct reserves the right not to delete content posted on the internet platform, but the name of the user will be removed. The user can, however, demand the partial or complete deletion of the content created by him/her if it either violates the rules of conduct for users, if there is a legal obligation to delete it or if personal rights are violated in a disproportionately severe manner. In such a case, ConAct reserves the right to make the content concerned legally compliant.
9. Rights of use
By posting content on the internet platform, the user grants ConAct a simple, royalty-free, transferable, spatially and temporally unrestricted right to use the content to make it permanently accessible to the community on the internet platform. The user has the option to make the content accessible only to a limited part of the community via the function menu of the internet platform. These rights of use shall also apply to posted content beyond the term of the contract if and insofar as the user has not independently removed the content.
10. Modification of the terms of use
ConAct may subsequently change these terms and conditions if and to the extent that the main service character of the contract is not changed more than insignificantly as a result (see section 2). ConAct will inform the user of the changed conditions. If the user does not agree with these changes, he/she may declare his/her objection within six weeks after receipt of the notification of change. If no objection is made within this period, the changes shall be deemed to have been approved. In the event of an objection, the contract shall continue to apply unchanged, although ConAct may exercise its right to terminate the contract.
11. Applicable law, place of performance and jurisdiction
11.1 German law shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If the user has his/her habitual residence in another EU member state, the applicability of these mandatory consumer protection standards of that state shall remain unaffected.
11.2 For all current and future claims arising from or in connection with this contract with merchants, legal entities under public law or special funds under public law, the exclusive place of jurisdiction shall be the registered office of ConAct. The same place of jurisdiction shall apply if the user does not have a general place of jurisdiction in Germany, moves his/her place of residence or habitual abode out of Germany after conclusion of the contract, or if his/her place of residence or habitual abode is unknown at the time the action is filed. Deviating provisions of Art. 17 et seq. EuGVVO regarding the place of jurisdiction for consumers remain unaffected.
Nutzungsbedingungen von MyGIX – The German-Israeli Exchange Network
1. Geltungsbereich
1.1 Diese Bedingungen gelten für die Nutzung der Internetplattform „MyGIX – The German-Israeli Exchange Network“ sowohl in der Desktop-Version als auch über die mobile App. MyGIX – The German-Israeli Exchange Network wird von ConAct – Koordinierungszentrum Deutsch-Israelischer Jugendaustausch, Altes Rathaus – Markt 26, 06886 Lutherstadt Wittenberg (nachfolgend „ConAct“) betrieben.
1.2 Für die Nutzung der Internetplattform gelten ausschließlich diese Nutzungsbedingungen in ihrer zum Zeitpunkt des Vertragsschlusses (Registrierung) gültigen Fassung. Abweichende Bedingungen der Nutzer*innen finden keine Anwendung, es sei denn, ConAct hat ihrer Geltung ausdrücklich zugestimmt.
2. Leistungsbeschreibung
2.1 Mit der Internetplattform stellt ConAct den registrierten Nutzer*innen eine Kommunikationsplattform mit diversen Funktionen zur Verfügung, die im Rahmen der Kontakte aus deutsch-israelischen Austauschprogrammen und Freiwilligendiensten die Vernetzung, den Erfahrungsaustausch, Diskussionen und ein gemeinsames, interaktives Arbeiten der Nutzer*innen sowie die Präsentation von Ideen ermöglichen sollen.
2.2 Die Plattform steht den Nutzer*innen sowohl in einer Desktop-Version als auch einer mobilen App zur Verfügung.
2.3 Zielgruppe sind ehemalige, aktuelle und zukünftige Teilnehmende von deutsch-israelischen Jugendaustauschen im Bereich des schulischen, außerschulischen und beruflichen Jugendaustausches sowie von Freiwilligendiensten in Deutschland und Israel; ebenso Organisatorinnen und Organisatoren von deutsch-israelischen Jugendaustauschen, sowie Fach- und Lehrkräfte im deutsch-israelischen Jugendaustausch. Nutzer*innen, die die Plattform nicht im Kontext der deutsch-israelischen Austauschkontakte nutzen wollen, werden hiermit darauf aufmerksam gemacht, dass in diesem Fall ein anderes System von Ihnen zu nutzen ist. Sollten Nutzer*innen wiederholt gegen diese Vorgabe verstoßen, kann Ihr Nutzungskonto gelöscht werden.
2.4 Die Internetplattform ist für Nutzer*innen gedacht, die ein Alter von mindestens 12 Jahren erreicht haben.
2.5 ConAct ist bemüht, den Zugang zur Internetplattform allen Nutzer*innen 24 Stunden täglich und sieben Tage pro Woche zur Verfügung zu stellen. Vorübergehende Betriebsunterbrechungen, insbesondere aufgrund der üblichen Wartungsarbeiten, systemimmanenten Störungen des Internets sowie im Falle höherer Gewalt, sind allerdings möglich. Nutzer*innen haben deshalb keinen Anspruch auf eine jederzeitige, ununterbrochene Zugänglichkeit zu der Internetplattform. Es wird keine bestimmte Verfügbarkeit geschuldet.
3. Kosten
3.1 Für die Nutzung der Internetplattform erhebt ConAct von den Nutzer*innen grundsätzlich kein Entgelt. Auch die mobile App zur Nutzung der Plattform ist gebührenfrei.
3.2 Bei einer Nutzung der Internetplattform entstehen dem*der Nutzer*in gegebenenfalls Internet-Verbindungskosten, die von dem jeweiligen Vertrag der Nutzer*innen oder etwaigen sonstigen Verträgen abhängig sind und daher nicht Gegenstand dieser Bedingungen sein können.
4. Registrierung (Vertragsschluss)
4.1 Mit der Registrierung kommt der Vertrag zwischen dem*der Nutzer*in und ConAct zustande.
4.2 Zur Registrierung muss der*die Nutzer*in nach einem Klick auf den Menüpunkt „Sign up“ auf der Internetplattform mindestens die angegebenen Pflichtfelder des Anmeldeformulars wahrheitsgemäß ausfüllen, das heißt eine E-Mail-Adresse und ein Passwort festlegen. Ferner muss den Rechtstexten, das heißt den hier formulierten Nutzungsbedingungen sowie den Datenschutzbestimmungen zugestimmt werden.
4.3 Eingaben in dem Formular kann der*die Nutzer*in bis zur Absendung jederzeit korrigieren, ändern und löschen. Genügen die Angaben den Anforderungen nicht, erhält der*die Nutzer*in einen entsprechenden Hinweis. Mit dem Klick auf das Feld „Sign up“ gibt der*die Nutzer*in einen verbindlichen Antrag über den Abschluss des Vertrages zur Nutzung der Internetplattform ab. Die Registrierung wird hierdurch abgeschlossen und das Formular an ConAct gesendet. Auf diesen Antrag erhält der*die Nutzer*in eine automatisch generierte Bestätigungs-E-Mail zu der von ihm*ihr eingetragenen E-Mail-Adresse. Mit dem in der Bestätigungs-E-Mail enthaltenen Hyperlink ist es möglich, das Nutzer*innen-Konto vollständig zu aktivieren. Mit dem Akzeptieren des ersten Logins und der Bereitstellung der Leistung nimmt ConAct den Antrag an.
4.4 Nicht volljährige Nutzer*innen dürfen sich nur mit Zustimmung ihrer Erziehungsberechtigten registrieren.
4.5 Bei unvollständigen oder nicht korrekten Daten in den Pflichtfeldern, insbesondere bei fehlerhafter E-Mail-Adresse, behält sich ConAct das Recht vor, das entsprechende Nutzer*innen-Konto zu löschen. Der*die Nutzer*in kann in diesem Fall jedoch ein neues Nutzer*innen-Konto unter vollständiger und korrekter Eingabe seiner*ihrer Daten anlegen.
4.6 Für den Vertragsschluss stehen dem*der Nutzer*in derzeit folgende Sprachen zur Verfügung: Deutsch und Englisch. Die Kommunikation mit ConAct kann in deutscher und englischer Sprache erfolgen.
4.7 Diese Nutzungsbedingungen muss der*die Nutzer*in im Rahmen der Anmeldung akzeptieren und kann sie hierbei einsehen. Sie können über die „Speichern“-Funktion des Webbrowsers gespeichert und über die „Drucken“-Funktion des Webbrowsers ausgedruckt werden. Abgesehen von den Nutzungsbedingungen wird kein Vertragstext gespeichert. In ihrer jeweils aktuellen Fassung werden diese Bedingungen auf MyGIX – The German-Israeli Exchange Network zur Verfügung gestellt.
5. Verhaltensregeln der Nutzer*innen, Freistellung
5.1 Die Nutzer*innen verpflichten sich zu einem respektvollen, sachlichen und sachbezogenen Umgang innerhalb der Internetplattform.
5.2 Die Nutzer*innen werden im Rahmen der Nutzung der Internetplattform die jeweils geltenden rechtlichen Bestimmungen einhalten. Insbesondere dürfen Fotografien von Dritten oder Dritte zeigende Fotografien nur eingestellt werden, wenn dies rechtlich zulässig ist, zum Beispiel weil diese Dritten ihre Zustimmung erteilt haben. Bei Minderjährigen ist die Zustimmung der Erziehungsberechtigten einzuholen.
5.3 Es ist den Nutzer*innen insbesondere untersagt,
- Inhalte einzustellen, ohne über die hierfür erforderlichen Rechte zu verfügen,
- gesetzlich (zum Beispiel durch das Urheber-, Marken-, Patent-, Design- oder Gebrauchs-musterrecht) geschützte Inhalte einzustellen oder Waren oder Dienstleistungen unter gesetzlich geschützten Zeichen (zum Beispiel Marken) zu bewerben, anzubieten oder zu vertreiben, ohne dazu berechtigt zu sein,
- diskriminierende, menschenverachtende, Terrorismus fördernde oder gutheißende, beleidigende, rechtswidrige oder gegen die guten Sitten verstoßende Inhalte einzustellen,
- pornografische oder gegen Jugendschutzgesetze verstoßende Inhalte einzustellen oder pornografische oder gegen Jugendschutzgesetze verstoßende Inhalte zu bewerben, anzubieten oder zu vertreiben,
- andere Nutzer*innen unzumutbar (insbesondere durch Spam) zu belästigen,
- kommerziell werbende und wettbewerbswidrige Handlungen vorzunehmen oder zu fördern,
- Handlungen auszuüben, die geeignet sind, die Funktionalität der von ConAct bereitgestellten Infrastruktur zu beeinträchtigen, insbesondere diese übermäßig zu belasten.
5.4 Bei Verletzung der vorstehenden Regeln oder rechtswidrigem Handeln von Nutzer*innen innerhalb der Internetplattform ist ConAct nach eigenem Ermessen berechtigt, Nutzer*innen zeitweise oder dauerhaft von der Nutzung der Internetplattform auszuschließen (einschließlich der Löschung des Nutzer*innen-Kontos) und, soweit erforderlich, weitere Maßnahmen zu ergreifen, um die Verletzung abzustellen. ConAct ist in solchen Fällen insbesondere berechtigt, Inhalte ohne Vorankündigung zu entfernen.
5.5 Des Weiteren hat der*die Nutzer*in ConAct sowie dessen jeweilige Vertreter*innen von jeglichen Ansprüchen (einschließlich angemessener Rechtsanwaltskosten) freizustellen und schadlos zu halten sowie dagegen zu verteidigen, die Dritte wegen der vermeintlichen Verletzung dieser Bestimmungen oder ihrer Rechte geltend machen. Der*die Nutzer*in ist verpflichtet, ConAct für den Fall einer Inanspruchnahme durch Dritte unverzüglich sämtliche Informationen zu übermitteln, die für eine Prüfung der Ansprüche des Dritten erforderlich sind.
6. Mitteilung anstößiger Inhalte
Nutzer*innen haben jederzeit die Möglichkeit, ihnen anstößig erscheinende Inhalte ConAct und deren Vertreter*innen mitzuteilen. Die Mitteilung kann insbesondere per E-Mail oder über den dafür vorgesehenen Link innerhalb der Internetplattform erfolgen.
7. Verhaltensregeln und Verantwortung von ConAct
7.1 ConAct wird die Kommunikation der Nutzer*innen innerhalb von Gruppen anlassbezogen einsehen, insbesondere wenn anstößige Inhalte aus Gruppen gemeldet worden sind.
7.2 Die Nutzung der Internetplattform ist für die Bearbeitung und Bewilligung der bei ConAct eingegangenen Förderanträge ohne Bedeutung und hat hierauf keinen Einfluss.
7.3 ConAct kann technisch nicht mit Sicherheit feststellen, ob angemeldete Nutzer*innen tatsächlich diejenige Person darstellen, die sie zu sein vorgeben. ConAct bietet daher keine Gewähr für die tatsächliche Identität der Nutzer*innen. Jede*r Nutzer*in hat sich daher selbst von der Identität der anderen Nutzer*innen zu überzeugen.
7.4 ConAct übernimmt keine Verantwortung für die von Nutzer*innen bereitgestellten Inhalte, Daten und/oder Informationen. ConAct gewährleistet insbesondere nicht, dass diese Inhalte wahr sind, einen bestimmten Zweck erfüllen oder einem solchen Zweck dienen können.
8. Vertragslaufzeit
8.1 Der*die Nutzer*in kann die Mitgliedschaft in der Internetplattform jederzeit ohne Angabe von Gründen durch einen Klick auf „Yes, I want to leave this network“ im Nutzer*innen-Konto beenden. Alternativ kann der*die Nutzer*in sich schriftlich oder per E-Mail info@mygix.org an ConAct wenden.
8.2 ConAct kann die Mitgliedschaft von Nutzer*innen jederzeit ordentlich mit einer Frist von 14 Tagen schriftlich oder per E-Mail an den*die Nutzer*in beenden.
8.3 Das Recht beider Parteien zur Kündigung aus wichtigem Grund bleibt unberührt. Ein wichtiger Grund liegt für ConAct insbesondere dann vor, wenn der*die Nutzer*in gegen diese Nutzungsbedingungen nicht nur unerheblich oder mehrfach verstößt, insbesondere wenn der*die Nutzer*in gegen die vorstehenden Verhaltensregeln für Nutzer*innen verstößt.
8.4 Mit erfolgter Kündigung werden das Nutzer*innen-Konto und die Kontoinhalte des Nutzers/der Nutzerin vollständig und unwiederbringlich gelöscht. ConAct behält sich das Recht vor, in der Internetplattform eingestellte Inhalte nicht zu löschen, allerdings wird der Name des Nutzers/der Nutzerin entfernt. Der*die Nutzer*in kann jedoch die teilweise oder vollständige Löschung der von ihm*ihr erstellten Inhalte verlangen, wenn diese entweder gegen die Verhaltensregeln für Nutzer*innen verstoßen, eine gesetzliche Pflicht zur Löschung besteht oder Persönlichkeitsrechte unverhältnismäßig schwer verletzt werden. Für diesen Fall behält sich ConAct das Recht vor, die betroffenen Inhalte rechtskonform zu gestalten.
9. Nutzungsrechte
Mit dem Einstellen von Inhalten in die Internetplattform räumt der*die Nutzer*in ConAct ein einfaches, unentgeltliches, übertragbares, räumlich und zeitlich unbeschränktes Nutzungsrecht an den Inhalten ein, diese Inhalte dauerhaft auf der Internetplattform der Community zugänglich zu machen. Der*die Nutzerin hat über das Funktionsmenü der Internetplattform die Möglichkeit, die Inhalte nur einem eingeschränkten Teil der Community zugänglich zu machen. Diese Nutzungsrechte gelten für eingestellte Inhalte auch über die Laufzeit des Vertrags hinaus, wenn und soweit der*die Nutzer*in die Inhalte nicht selbständig entfernt hat.
10. Änderung der Nutzungsbestimmungen
ConAct kann diese Bedingungen nachträglich ändern, wenn und soweit dadurch nicht der Hauptleistungscharakter des Vertrages mehr als nur unerheblich geändert wird (vgl. Ziffer 2). ConAct wird dem*der Nutzer*in die geänderten Bedingungen mitteilen. Wenn der*die Nutzer*in mit diesen Änderungen nicht einverstanden ist, kann er*sie innerhalb von sechs Wochen nach Zugang der Änderungsmitteilung den Widerspruch erklären. Erfolgt in dieser Zeit kein Widerspruch, gelten die Änderungen als genehmigt. Im Falle des Widerspruchs gilt der Vertrag unverändert weiter, allerdings wird ConAct gegebenenfalls vom ordentlichen Kündigungsrecht Gebrauch machen.
11. Anwendbares Recht, Erfüllungsort und Gerichtsstand
11.1 Es gilt ausschließlich deutsches Recht unter Ausschluss des UN-Kaufrechts. Hat der*die Nutzer*in seinen gewöhnlichen Aufenthalt in einem anderen Mitgliedstaat der EU, bleibt die Anwendbarkeit dieser zwingenden verbraucherschützenden Normen dieses Staates unberührt.
11.2 Für sämtliche gegenwärtigen und zukünftigen Ansprüche aus oder im Zusammenhang mit diesem Vertrag mit Kaufleuten, juristischen Personen des öffentlichen Rechts oder öffentlich-rechtlichem Sondervermögen ist ausschließlicher Gerichtsstand der Sitz von ConAct. Der gleiche Gerichtsstand gilt, wenn der*die Nutzer*in keinen allgemeinen Gerichtsstand im Inland hat, nach Vertragsabschluss seinen*ihren Wohnsitz oder gewöhnlichen Aufenthaltsort aus dem Inland verlegt oder sein*ihr Wohnsitz oder gewöhnlicher Aufenthaltsort zum Zeitpunkt der Klageerhebung nicht bekannt ist. Abweichende Bestimmungen der Art. 17 ff. EuGVVO zum Gerichtsstand bei Verbrauchern bleiben unberührt.
