Privacy Policy of MyGIX – The German-Israeli Exchange Network – Community Part
MyGIX – The German-Israeli Exchange Network – Community Part (hereinafter only: MyGIX Community) is the core service that goes beyond the publicly accessible area of the website https://mygix.org/, and is usable in a desktop version as well as via a mobile app. In addition to the privacy policy of the website, the following provisions on data protection therefore apply.

MyGIX Community is an internet platform for the exchange of information and news between members. The service is not publicly accessible, so that only registered members can access it. The creation of an account for membership is connected with the collection, storage and processing of personal data. Before a data collection/storage/processing procedure begins, a potential member is informed in this way about all circumstances relevant to data protection and must agree to these procedures in advance.
With the creation of an account for the MyGIX community platform a contract between us and the member about the use of the platform comes into being. So that we can fulfill our obligations from the contract towards the member, the collection, storage and processing of data is necessary. The legal basis in this respect is Art. 6 para. 1 lit. c) DSGVO.
Only the personal data that the member provides when or after creating an account on the platform is collected. These are in particular, but not conclusively:
Since all information, with the exception of the email address, is provided voluntarily, we understand the registration as consent to the use of the data provided. The consent can be revoked at any time and without compliance with a specific form.
There is also a storage of the member's activities on the platform (posts, comments, pictures, calendar events, etc.) and a connection with the account.
The member itself thus decides which personal data is stored and processed by us. The only requirement for creating an account is a valid email address.
As a matter of principle, we do not pass on data to third parties – with the exception of data collected for statistical purposes (see the corresponding regulations in the privacy policy of the website https://mygix.org/ under the headings "Cookies" and "Statistics, representation, co-operation with authorities") and the necessary visualization of the data and/or content provided by the member for the MyGIX Community. In addition, for the purpose of geolocation, the address data will be transferred without name to a third party within the scope of the GDPR to resolve the geolocations.
With the creation of an account the member declares to have read and understood these supplementary data protection regulations and to agree with the extent of the collection, storage and processing of his personal data described therein. In this respect, by creating the account, the member declares his consent within the meaning of Art. 6 para. 1 lit. a) DSGVO. This consent also applies to data that is not required for the fulfillment of the contract by ConAct.
On the pages of the MyGIX Community there is the possibility of integration of contents of external websites or providers. These are only displayed to other members if the respective member explicitly agrees to this in the individual case by selecting the button. By such a consent, the collection, processing and forwarding of personal data to these third-party providers is sometimes agreed. We point out that a combination with other data stored about the member by these third-party providers may occur. In this respect, the additional conditions on data protection of the respective third-party provider must be observed.
The personal data of the member will be stored for the duration of the existence of the account. If the member makes use of the option to delete the account, the data will be deleted in its entirety. Only the contributions (posts) published by the member will remain, but will then be displayed as contributions of a "Deleted User". If the member also wishes the deletion of all posts published within the MyGIX Community, we ask for notification of the posts to be deleted, stating the information necessary for identification, so that these can also be deleted.
If the member uses MyGIX Community via the tixxt app, an offer of mixxt GmbH, the data protection regulations for the tixxt app apply additionally, which the member has to accept when installing the app.
According to the DSGVO or the BDSG, the persons affected by the data processing have a right to information (Art.15 DSGVO) about the data collected from them, can demand a confirmation about the data processing and a provision of a copy of the data as well as a right to complain to the competent supervisory authority (Art. 77 DSGVO). You have a right to rectification (Art. 16 DSGVO), which may also lie in the completion of the data. You have a right to erasure ("being forgotten") (Art. Art. 17 DSGVO) and a right to restriction of processing (Art. 18 DSGVO) as well as a right to data portability (Art. 20 DSGVO). Data subjects have a right to object (Art. 21 DSGVO) to future processing of data and the restrictions on automated decisions in individual cases, including profiling (Art. 22 DSGVO) apply. If you have consented to the data processing and the data is processed on this basis, you have the right to withdraw this consent at any time.

MyGIX – The German-Israeli Exchange Network – Community-Teil (im Folgenden nur noch: MyGIX Community) ist das Kernangebot, das über den uneingeschränkt allen Nutzern zugänglichen Bereich der Website https://mygix.org/ hinausgeht und sowohl in einer Desktop-Version als auch über eine mobile App nutzbar ist. In Ergänzung zu der Datenschutzerklärung der Website gelten daher die folgenden Bestimmungen zum Datenschutz.

MyGIX Community ist eine Internetplattform zum Austausch von Informationen und Nachrichten zwischen den Mitgliedern. Das Angebot ist nicht öffentlich zugänglich, so dass nur registrierte Mitglieder darauf zugreifen können. Das Anlegen eines Accounts für die Mitgliedschaft ist mit der Erhebung, Speicherung und Verarbeitung von personenbezogenen Daten verbunden. Bevor ein Datenerhebungs-/speicherungs-/verarbeitungsvorgang beginnt, wird auf diesem Wege ein potentielles Mitglied über alle datenschutzrelevanten Umstände informiert und muss diesen Vorgängen vorab zustimmen.
Mit dem Anlegen eines Accounts für die MyGIX-Community-Plattform kommt ein Vertrag zwischen uns und dem Mitglied über die Nutzung der Plattform zustande. Damit wir unsere Pflichten aus dem Vertrag gegenüber dem Mitglied erfüllen können, ist die Erhebung, Speicherung und Verarbeitung von Daten notwendig. Die Rechtsgrundlage stellt insoweit Art. 6 Abs. 1 lit. c) DSGVO dar.
Erhoben werden ausschließlich die personenbezogenen Daten, die das Mitglied bei oder nach dem Anlegen eines Accounts auf der Plattform bereitstellt. Dies sind insbesondere, aber nicht abschließend:
Da alle Angaben mit Ausnahme der E-Mail-Adresse freiwillig erfolgen, verstehen wir die Registrierung als Einwilligung in die Nutzung der angegebenen Daten. Die Einwilligung kann jederzeit und ohne Einhaltung einer bestimmten Form widerrufen werden.
Es erfolgt zudem eine Speicherung der Aktivitäten des Mitglieds auf der Plattform (Posts, Kommentare, Bilder, Kalender-Events, usw.) und eine Verbindung mit dem Account.
Das Mitglied entscheidet somit selbst, welche personenbezogenen Daten von uns gespeichert und verarbeitet werden. Voraussetzung für das Erstellen eines Accounts ist lediglich eine gültige E-Mail-Adresse.
Eine Weitergabe von Daten an Dritte erfolgt durch uns grundsätzlich nicht – mit Ausnahme der zu statistischen Zwecken erhobenen Daten (siehe dazu die entsprechenden Regelungen in der Datenschutzerklärung der Website https://mygix.org/ unter den Überschriften „Cookies“ und „Statistik, Darstellung, Zusammenarbeit mit Behörden“) und der notwendigen Sichtbarmachung der von dem Mitglied bereitgestellten Daten bzw. Inhalte für die MyGIX Community. Zudem werden zum Zweck der Geolokalisierung die Adressdaten ohne Namen an einen Dritten innerhalb des Geltungsbereiches der DSGVO übergeben, um die Geolocations aufzulösen.
Mit dem Erstellen eines Accounts erklärt das Mitglied, diese ergänzenden Datenschutzbestimmungen gelesen und verstanden zu haben und mit dem darin beschriebenen Umfang der Erhebung, Speicherung und Verarbeitung seiner personenbezogenen Daten einverstanden zu sein. Insoweit erklärt das Mitglied durch das Erstellen des Accounts seine Einwilligung im Sinne von Art. 6 Abs. 1 lit. a) DSGVO. Diese Einwilligung gilt auch für Daten, die nicht zur Vertragserfüllung durch ConAct erforderlich sind.
Auf den Seiten der MyGIX Community besteht die Möglichkeit der Einbindung von Inhalten externer Websites bzw. Anbieter. Diese werden anderen Mitgliedern nur angezeigt, wenn das jeweilige Mitglied dem im Einzelfall ausdrücklich durch Auswahl des Buttons zustimmt. Durch eine solche Zustimmung wird mitunter der Erhebung, Verarbeitung und Weiterleitung von personenbezogenen Daten an diese Drittanbieter zugestimmt. Wir weisen darauf hin, dass eine Zusammenführung mit anderen über das Mitglied bei diesen Drittanbietern gespeicherten Daten erfolgen kann. Es sind insoweit die zusätzlichen Bedingungen zum Datenschutz des jeweiligen Drittanbieters zu beachten.
Die personenbezogenen Daten des Mitglieds werden für die Dauer des Bestehens des Accounts gespeichert. Macht das Mitglied von der Möglichkeit des Löschens des Accounts Gebrauch, werden die Daten insgesamt gelöscht. Es bleiben lediglich die durch das Mitglied veröffentlichten Beiträge (Posts) erhalten, die sodann aber als Beiträge eines „Deleted User“ angezeigt werden. Wünscht das Mitglied auch die Löschung aller innerhalb der MyGIX Community veröffentlichten Beiträge, bitten wir um Mitteilung der zu löschenden Beiträge unter Nennung der zur Identifizierung notwendigen Angaben, damit diese ebenfalls gelöscht werden können.
Nutzt das Mitglied MyGIX Community über die tixxt App, ein Angebot der mixxt GmbH, gelten ergänzend die Datenschutzbestimmungen für die tixxt App, die das Mitglied bei der Installation der App anerkennen muss.
Nach der DSGVO bzw. dem BDSG haben die von der Datenverarbeitung Betroffenen ein Auskunftsrecht (Art.15 DSGVO) über die von ihnen erhobenen Daten, können eine Bestätigung über die Datenverarbeitung und eine Zurverfügungstellung einer Kopie der Daten verlangen sowie ein Beschwerderecht bei der zuständigen Aufsichtsbehörde (Art. 77 DSGVO). Sie haben ein Recht auf Berichtigung (Art. 16 DSGVO), das auch in der Vervollständigung der Daten liegen kann. Sie haben ein Recht auf Löschung („Vergessenwerden“) (Art. Art. 17 DSGVO) und ein Recht auf Einschränkung der Verarbeitung (Art. 18 DSGVO) sowie ein Recht auf Datenübertragbarkeit (Art. 20 DSGVO). Betroffene haben ein Recht auf Widerspruch (Art. 21 DSGVO) der künftigen Verarbeitung der Daten und es gelten die Einschränkungen zu den Automatisierten Entscheidungen im Einzelfall einschließlich Profiling (Art. 22 DSGVO). Wenn Sie in die Datenverarbeitung eingewilligt haben und die Daten auf dieser Grundlage verarbeitet werden, haben Sie jederzeit ein Recht auf Widerruf dieser Einwilligung.
